Good day fellow Teachers. We’ve been together for three years now. We had a lot of struggles in our beloved profession but we made it to this new school year together – supporting and sharing our knowledge for the welfare of each other. We were always there for each other as we dreamed of a smooth and productive school year. Together we withstood the challenges. AN ACT
PROVIDING FOR EDUCATIONAL ASSISTANCE TO PUBLIC SCHOOL TEACHERS AND APPROPRIATING FUNDS THEREOF

EXPLANATORY NOTE

Shortage of trained and qualified teachers is a major concern in our public educational system. One major reason for such is the lack of funds and absence of opportunities for further studies that public teachers may avail.

Undeniably, public teachers play a significant role in educating the Filipino youth who in turn become the future leaders of this country. They play an extraordinary part in the lives of Filipino children, molding them to become responsible citizens in the future. Thus, major efforts should be undertaken to give our teachers adequate training in order to ensure quality education.

In view of the foregoing, the passage of this bill is earnestly sought.

AN ACT
PROVIDING FOR EDUCATIONAL ASSISTANCE TO PUBLIC SCHOOL TEACHERS AND APPROPRIATING FUNDS THEREOF

 

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

Section 1. Declaration of Policy. – It is the declared policy of the State to give priority to the needs of public school teachers. It is likewise hereby declared to be the policy of the State to promote and improve their economic status and to assist them in providing quality education to their students.

Sec. 2. Definition. – “Public School Teachers” shall refer to all persons engaged in classroom teaching, in any level of instruction, on full-time basis, including guidance counselors, industrial arts or vocational instructors, school heads, supervisors, and all other persons performing supervisory and/or administrative functions in all schools, colleges, and universities operated by the Government or its political subdivisions.

Sec. 3. Educational Benefits. – In addition to all other benefits to which they are entitled under existing laws, rules and regulations, eligible public school teachers are herein provided with educational privileges in the form of scholarship grants. The scholarship grants shall be institutionalized in post-graduate programs, free of any charge including but not limited to tuition and matriculation fees.

Sec. 4. Eligibility. – Public school teachers who are in active service shall be eligible to avail of the scholarship grants to enroll in any masteral or post graduate course. Provided, the public school educator shall have been in active duty for at least two (2) consecutive years immediately prior to the date of application for the grant. Provided further, that the public school teacher who shall avail of this grant shall sign an undertaking that he or she shall be professionally engaged with any school, college, and university operated by the Government or its political subdivisions for a period of five (5) years upon completion of the masteral or post graduate course. Otherwise, he or she shall reimburse the amount the scholarship grant if he or she fail or refuse to serve any school, college, and university operated by the Government or its political subdivision for no justifiable reason.

Sec. 5. Schools were scholarship grant applicable. – The scholarship grant shall be applicable in all state colleges and universities or state vocation or technical schools throughout the country. The eligible public school teacher shall only be qualified to avail of the scholarship grant upon meeting and passing the requirements set by the respective schools.

Sec. 6. Implementing Rules and Regulations. – The Department of Education (DepEd), Commission on Higher Education (CHED) and the Technical Education and Skills Development Authority (TESDA) shall formulate the necessary guidelines to carry out the provisions of this Act.

Sec. 7. Repealing Clause. – All laws, decrees, executive orders, proclamations, rules and regulations and other issuance or parts thereof, inconsistent with the provisions of this Act are hereby repealed or modified accordingly.

Sec. 8. Separability Clause. – If, for any reason, any section or provision of this Act is held unconstitutional or invalid, the other sections or provisions hereof shall not be affected thereby.

Sec. 9. Effectivity. – This Act shall take effect fifteen (15) days after its complete publication in at least two (2) newspapers of general circulation.
